Bail Granted to Murder Suspect Despite Admitting Involvement in Dipu Chandra Das Case

The defendant Mohammad Masoom, one of the accused in the sensational Dipu Chandra Das murder case in Valuska, Mymensingh, has been granted one year’s conditional bail by the High Court.
On Monday (13 April), bail papers were issued through the Chief Judicial Magistrate’s Court in Mymensingh. On 6 April, a two-judge bench of the High Court Division granted the bail order. The rapid granting of bail to the accused in this sensational murder case has provoked anger among concerned parties.
According to court sources, the bail hearing was conducted before a bench comprising Justice Kaji Mo. Izarul Haq Akand and Justice Syed Hasan Jobayer of the High Court Division. The court granted bail to Masoom for one year in response to an application under Section 498 of the Criminal Procedure Code. According to case documents, Masoom is the son of Mohammad Chan Mia, a boatman from Bahadurpur village, Sibjhar Thana, Madaripur District.
Following the High Court’s order, on 13 April, the Chief Judicial Magistrate’s Court in Mymensingh accepted bail papers valued at two thousand taka and issued an order for his release. The defendant’s father signed as the local surety on the bail bond.
Previously, from last year’s 19 December, he was in prison in connection with the Dipu Chandra Das murder case filed at Valuska Model Police Station. He faces charges under sections 147/149/302/201/297/34 of the Penal Code. These sections include charges such as murder and corpse disposal.
Currently, the District Detective Branch (DB) is investigating the murder case. Masoom himself had confessed during interrogation to his involvement in the murder.
Senior police officers in the district have expressed anger at how an accused who gave a confessional statement in this highly sensitive case obtained bail so quickly. According to them, “After months of police operations, the accused were arrested. Now if the accused escape easily through legal loopholes, the judicial process will be prolonged and other accused will also seek opportunities to obtain bail using the same precedent.”
Apu Robi Das, the brother of deceased Dipu Das, expressed anger, saying: “This important accused in the case confessed to the murder under Section 164. But if the murderers obtain bail and walk out proudly in just a few days, who should we ordinary people seek justice from? We urge the government to file an appeal against this bail order in the higher court.”
It may be noted that the case was filed following an incident in which Dipu Chandra Das was pressured to resign from his factory job after being incited by workers on allegations of religious insult, followed by his brutal murder and the subsequent public burning of his corpse.​​​​​​​​​​​​​​​​
